The Dow fell 100 points at the open Monday, then climbed back above 13,000 after a report that the number of Americans who signed contracts to buy homes rose in January to the highest in almost two years.
The National Association of Realtors said its index of sales agreements rose 2 percent last month to a reading of 97, the highest since April 2010. A reading of 100 is considered healthy.
Financial stocks led the industries gaining ground Monday. They rose 0.9 percent as a group. All nine of the other industry groups in the S&P 500 finished with small gains or narrow losses.
Scott Wren, senior equity strategist for Wells Fargo Advisors in St. Louis, said investors have gotten ahead of themselves since October. The S&P 500 is up 8.8 percent this year alone.
He said he thinks U.S. economic growth is likely to be a mild 2 percent this year, there are fewer people working now than there were at the end of 2007, and Europe may be in a recession.
"I don't see any reason for the market to be on some incredible run," he said.
The price of oil fell below $109 a barrel as investors booked profits after a 14 percent gain this month driven by signs of an improving U.S. economy and fears of an Iranian supply cut. Benchmark crude fell by $1.21 to end the day at $108.56 per barrel in New York.
Government figures show that growth in demand for crude oil has slowed in the U.S. from a year earlier, although some oil traders are betting a strengthening economy will eventually boost consumption.
"Four dollar (a gallon) gas, that's not going to really shut down the economy," Wren said. "$5, $6 gas, that's a different story."
The average U.S. price of a gallon of gasoline has jumped 18 cents over the past two weeks, with a gallon of regular at $3.70 (98 cents a liter).
Overseas markets fell slightly because of worries about high oil prices. Stocks fell 0.3 percent in Britain, 0.2 percent in Germany and 0.7 percent in France.
The European debt crisis is also still a lingering concern. Finance ministers from the world's 20 leading economies said that they would not add money to the International Monetary Fund until the European Union puts up more money to stave off its debt crisis.
Other commodities rose, including a 1.2 percent rise in wheat prices in Chicago. Soybeans topped $13 a bushel for the first time in five months. Global soybean supplies are tight, and hot, dry weather has damaged crops in Brazil and Argentina.
Among U.S. stocks making moves:
? Cooper Tire & Rubber Company Co. rose 13.9 percent after it said net income more than quadrupled in the fourth quarter, mostly because of a large tax-related gain.
? Chipmaker Micron Technology Inc. rose 7.7 percent after a Japanese rival company filed for bankruptcy protection.
? Warren Buffett's Berkshire Hathaway Inc. rose 0.3 percent after the investor, known as the Oracle of Omaha, said the company has a successor in mind, plus two backups. Berkshire has not named those executives.
? Shares of Sprint Nextel Corp. rose 3.2 percent after reports that its board rejected a purchase of MetroPCS Communications. MetroPCS fell 1.5 percent.
? Lowe's, the home improvement chain, rose 0.7 percent after reporting a 13 percent jump in fourth-quarter profits.

Apple's China legal battle over iPad trademark moves to U.S.
A Chinese firm trying to stop Apple Inc from using the iPad name in China has launched an attack on the consumer electronics giant?s home turf, filing a lawsuit in California that accuses it of employing deception when it bought the trademark.
A unit of Proview International Holdings Ltd, a major computer monitor maker that fell on hard times during the global financial crisis, is already suing Apple in multiple Chinese jurisdictions and requesting that sales of iPads be suspended across the country.
Last week, Proview Electronics Co Ltd and Proview Technology Co filed a lawsuit in Santa Clara County that brings their legal dispute to Silicon Valley.
Some legal experts said there could be different outcomes from the U.S. and Chinese cases, but a spreading of the lawsuit and delay in coming to settlement terms could hurt Apple more.
?In relation to the U.S., Apple is going to somewhat have a homeground advantage,? said Elliot Papageorgiou, a Shanghai-based partner and executive at law firm Rouse Legal (China).
At stake for Apple is its sales and shipments in China, where its CEO Tim Cook said it was merely scratching the surface. Debt-laden Proview International, meanwhile, needs to come up with a viable rescue plan before mid-2012 or else it faces delisting from the Hong Kong stock exchange.
?Given the current timeline, Apple would have the greater impetus to come to settlement simply because the ability to disrupt shipments is more immediate than the pressure faced by Proview and its potential delisting,? said Papageorgiou.
Proview accuses Apple of creating a special purpose entity ? IP Application Development Ltd, or IPAD ? to buy the iPad name from it, concealing Apple?s role in the matter.
In its filing, Proview alleged lawyers for IPAD repeatedly said it would not be competing with the Chinese firm, and refused to say why they needed the trademark.
Those representations were made ?with the intent to defraud and induce the plaintiffs to enter into the agreement,? Proview said in the filing dated February 17, requesting an unspecified amount of damages.
Apple on Friday reiterated its statement saying that it had bought Proview?s worldwide rights to the iPad trademark in 10 different countries several years ago. It also said that Proview had refused to honor their agreement and a Hong Kong court had sided with the U.S. technology giant in the matter.
?Our case is still pending in mainland China,? Apple said.
DISPUTE HINGES ON 2009 DEAL
The battle between a little-known Asian company and the world?s most valuable technology corporation dates back to a disagreement over precisely what was covered in a deal for the transfer of the iPad trademark to Apple in 2009.
Authorities in several Chinese cities, such as Shijiazhuang and Huizhou, have already banned the sale of iPads, citing the legal dispute.
Proview, which maintains it holds the iPad trademark in China, has been suing Apple in various jurisdictions in the country for trademark infringement, while also using the courts to get retailers in some smaller cities to stop selling the tablet PCs.
Major electronics retailer Suning has resumed selling iPads online this week in China after it stopped sales last week due to a supply shortage, rather than because of the lawsuit, company executives said.
China is becoming an increasingly pivotal market for Apple, which sold more than 15 million iPads worldwide in the last quarter alone and is trying to expand its business in the world?s No. 2 economy to sustain its rip-roaring pace of growth.
It now has a 76 percent market share in China?s tablet PC sector, followed by Lenovo Group Ltd and Samsung Electronics Co Ltd that have a combined share of only 10 percent, data from research firm IDC showed.
The country is also where the majority of its iPhones and iPads are now assembled, in partnership with Taiwan?s Foxconn.
A Shanghai court this week threw out Proview?s request to halt iPad sales in the city. But the outcome of the broader dispute hinges on a higher court in Guangdong, which earlier ruled in Proview?s favor.
The next hearing in that case is set for February 29. Proview lawyers said there might not be a decision immediately and it could take weeks or months before there was an outcome.
?It is more appropriate for both parties to mediate. I think that is the best outcome,? David Chen, senior partner at Allbright Law Offices in Shanghai.
China?s trademark system is a minefield of murky rules and opportunistic ?trademark squatters? that even the world?s biggest companies and their highly-paid lawyers find hard to navigate.

Dr Saeed was Attorney General under former President Maumoon Abdul Gayoom?s administration. After breaking from the MDP coalition that unseated the 30 year autocrat in 2008, Saeed?s Dhivehi Qaumee Party (DQP) was vocal in its criticism of government policy, particularly a 25 year concession agreement between Ibrahim Nasir International Airport and Indian infrastructure giant GMR involving the construction of a new terminal.
The Vice President of his party, Dr Mohamed Jameel ? now the Home Minister ? was also a vocal critic of the government?s religious credentials, in January distributing a pamphlet entitled ?President Nasheed?s devious plot to destroy the Islamic faith of Maldivians?.
Dr Saeed was also one the first to raise concerns about the conduct of Chief Judge of the Criminal Court, Abdulla Mohamed, in a letter to Gayoom in 2005.

Minnesota Twins reliever Joel Zumaya was diagnosed with a torn ligament in his right elbow on Sunday, meaning his latest comeback bid has ended almost before it began.
Zumaya had signed an incentive-laden, one-year deal with the Twins, who hoped he could bolster their bullpen with his 100 mph heat. General manager Terry Ryan knew Zumaya's long injury history when he offered the contract, but the possibility of getting the overpowering arm that electrified the Tigers in 2006 intrigued him.
"I took a risk. It was a high risk with high reward," Ryan said after the MRI exam revealed the torn ulnar collateral ligament. "Unfortunately it didn't work. And he feels bad. I feel bad."
Zumaya lasted just 13 pitches in his first session of live batting practice Saturday before walking off the mound with pain in his elbow. Ryan spoke with him on Sunday after they received the news, but said it was too early to talk about Zumaya's plans for the future.
The 27-year-old could choose to have Tommy John surgery and start another exhaustive rehab program that could last a year or longer. Or he could choose to retire.
"He's distraught, as you'd expect," Ryan said of Zumaya, who was unavailable for comment. "He's going to come in here in the next day or so and we're going to talk about the immediate future for him."
Zumaya had not thrown a pitch since June 2010 after breaking his elbow while pitching for Detroit in a game at Target Field. He has never been better than in his rookie season with the Tigers, when he was a 21-year-old blast furnace who struck out 97 hitters in 83 1-3 innings and became one of the most feared setup men in the game.
Injuries to his wrist, finger and shoulder followed, limiting him to fewer than 40 innings in each of the next four seasons. Then his elbow snapped in 2010, a frightening scene that led some to wonder if his body could withstand the sheer force of the pitches he uncorked.
But he had never torn the ulnar collateral ligament in his elbow, a common and devastating injury that usually requires surgery and at least 12 months of rehab before a pitcher is ready to get back on the mound.
After a long and arduous rehabilitation of his broken elbow, Zumaya worked out for several teams this winter. Looking for a right-hander at the back end of their bullpen to complement left-handed setup man Glen Perkins and closer Matt Capps, the Twins offered him $850,000. The contract is only guaranteed for $400,000.
"It's ironic that he tore this ligament because that was one of the area's he was healthy," Ryan said. "But when you have something break, sometimes other things go, too, and that's the chance you take. And that's the chance we took, I took. I'll take full responsibility for the decision, it just didn't work. It's as simple as that."
But Ryan said he didn't regret the decision to sign Zumaya.
"Sometimes you have to take chances," Ryan said. "It seemed like a worthwhile chance."
Zumaya had only been in the clubhouse for a couple of weeks, but he'd already managed to make a strong impression with the team. He pitched against the Twins for the Tigers and manager Ron Gardenhire said he quickly grew to like the heavily tattooed reliever who electrified Detroit's run to the World Series as a rookie in 2006.
"He looks like some monster out there pitching against you," Gardenhire said. "But you get him in your clubhouse and you realize there's special people and he's a special person and it's a really sad day for him and his family and our baseball team, too, because we were all hoping this guy would be able to get back on this thing and make it through. Unfortunately it didn't work out."
Left-hander Francisco Liriano was taken aback when he heard the news.
"Wow," said Liriano, who had Tommy John surgery in 2006. "I feel bad for him. He's been hurt probably every year. Wow."
Now the Twins have to look elsewhere among the 33 pitchers they brought to camp to help shore up their bullpen. Players like Anthony Swarzak, Alex Burnett, Jared Burton and Kyle Waldrop could get looks, even though none of them have strong histories of late-inning relief roles.
"If I'm one of those guys down in that clubhouse, well, there's some innings there to be had, I'd better go out there and get 'em," Ryan said. "You want to make the team? Let's go."

My son is wrapping up his last year of wrestling today, making his second and final appearance in the ?national? championship tournament for his league. Over the years, I have gone from barely being able to watch his matches to being an ardent fan with great respect for the sport.
The first year my son wrestled, I wasn?t into it at all. I didn?t really enjoy watching the boys, and felt so barbaric cheering them on. As the season wore on, I understood the sport more, could follow the scoring, and figured out why you need to ?lift his head!? when you have your competitor on his back (to force the shoulders on the ground to earn a pin). Still, when the season was over, I looked forward to cheering on the lacrosse team instead.
It took his second year for me to start to enjoy the matches. Well, I still don?t like it when the boys seem to bend their necks more than they should be able to go, or when arms and shoulders get twisted back too far, but for the most part, they wrestle ?clean? without hurting each other.
What I have really come to appreciate is how demanding wrestling is as a sport. Sure, a round may only last for 2 minutes, but you try keeping your shoulders off the ground for even 30 seconds using only your core strength while someone your weight is on top of you using all of his weight to try to push you down. There is also strategy in figuring out how to flip your opponent over without losing control and getting flipped yourself. I see it in the boys? faces as they try a move, reconsider, reset, and try again.
Wrestling offers so many lessons:
- It ain?t over until it?s over. You can be way ahead in points, but if you get careless, or tired, or the other guy gets lucky, you can find yourself on your back with the referee checking your shoulder blades for a pin. The good news is that this holds true when you are behind. There is always a chance that you can pin your opponent and win as long as you stay in the match and keep trying.
- Every second counts. A match can change direction so quickly. The wrestler who initiates a take-down may quickly find himself flat on the mat. The wrestler on the bottom may be able to flip around if his opponent is too high up on his back. Even if you are on your back, if you can keep a shoulder blade off the mat until the clock runs out, you may be able to escape a pin. Sometimes it seems that sheer determination earns the win.
?
- The number on the scale doesn?t tell you everything. Each weight class is separated by 5-17 pounds (at the higher weights) and most boys try to be at or near the high end of their weight class. That means that boys in the same weight class should weigh about the same, but they often look very different. There are boys with tall and lanky builds, boys with short and stocky builds, and every build in between. It?s not clear that either build necessarily has an advantage. More often it is skill (and maybe a bit of luck) that determines the winner?I?ve seen boys with different builds dominate their matches.
- You need to work with what you have. If you are tall and lanky, you need to use that height (and leverage) to your advantage. If you are short and stocky, you need to make that strength and stability work for you. No matter what your size, you can hone your skills and agility so you will be able to respond to your opponent?s strengths.
Another thing I really enjoyed about following my son?s wrestling team was the team ?family.? Parents make an effort to come to the matches and everyone cheers on each wrestler. It is fun to watch the boys grow and mature as the season goes on, and it is great to get to know the other parents as we pass the time between matches during the day-long tournaments.
It is also nice to see the boys come together as a team. While wrestling is a very individual sport, the boys seem to support each other in a way that we don?t see with other sports. It is so heart-warming to see these ?tough guys? giving each?other pep-talks, coaching each other through tough matches, helping each other shake off rough losses, and coming together to celebrate hard-earned victories.
Four years ago I never would have thought that I?d be sad to see my last wrestling tournament, but now wrestling is the first ?last? that I am getting sentimental about as my son finishes his senior year of high school.
