Verizon users hit with third data outage in December (Digital Trends)
According to a report out of Reuters, Verizon is investigating yet another outage of the data network. Noted as the third network outage during the month of December, some customers have reported an inability to connect to the?4G LTE network in a smattering of major U.S. cities including Los Angeles, New York City, Chicago and San?Francisco. ?Marquett Smith, vice president of?corporate communications for Verizon Wireless, released a statement that the company is currently working to resolve the new issue with the?4G LTE network. He stated ?The network continues to operate and all customers continue to be able to make calls, send text messages and utilize data services. 3G devices are operating normally.?
With the other problems causing issues for Verizon customers earlier this month, the cellular company has yet to release a statement on the cause of these outages. Verizon has been heavily promoting the?4G LTE network as a benefit over other cellular providers in national advertising campaigns on television, radio and the Web. According to Verizon, the?4G LTE network is supposed to offer speeds approximately ten times faster than the average speed of a 3G connection across various cellular providers. With approximately 3.7 million Android devices activated over the holiday weekend, the amount of new subscribers utilizing Verizon?s?4G LTE network may be too much of a burden on the data network in large?metropolitan?areas.?
While Verizon claims that all 3G devices are operating properly, customers have also been complaining of 3G outages as well. Customers have indicated that the 4G network is completely unavailable and their new device only connects to the 3G network?intermittently. These issues during December have gone against Verizon?s advertising slogan that claims the 4G LTE network is the??nation?s fastest, most?reliable?4G network.?

North Korea hails nuclear, military feats of Kim Jong-il (Reuters)
SEOUL (Reuters) ? North Korea lauded the military might built up by deceased leader Kim Jong-il on Thursday, likely tying his young successor to the same policies that have set Northeast Asia on edge as the impoverished state inches closer to nuclear weapons capability.
A gathering of 100,000, soldiers in uniform and bare-headed civilians, gathered in silence in wintry sunlight in the capital Pyongyang to mourn the passing of the man who had led the country for 17 years until his death on December 17.
Kim Jong-un, a jowly man in his late 20s who will become the third of his line to lead North Korea, took center stage overlooking the central square named after his grandfather to listen to tributes to the "great revolutionary."
"Great Leader Kim Jong-il ... laid the foundation for our people to live on as autonomous people of a world-class military power and a proud nuclear state," parliament chief Kim Yong-nam said in the eulogy.
The North has conducted two nuclear tests.
Larry Niksch, who has tracked North Korea for the non-partisan U.S. Congressional Research Service for 43 years, believes it could take as little as one to two years to have a working nuclear missile once it produced enough highly-enriched uranium for the warhead's core fuel.
That could threaten regional security and give the North a powerful bargaining tool in extracting aid for its economy.
North Korea's state television footage showed the young Kim flanked to his right by the country's top military general Ri Yong-ho on the balcony of the Granc People's Study House. Also nearby him were Defense Minister Kim Yong-chun, and his uncle and the key power-broker in the transition, Jang Song-thaek.
Jang, 65, is believed to be the regent heading a select group of caretakers, as the brother-in-law of Kim Jong-il who survived purges to become his closest confidant who oversaw the power succession before his death of a heart attack.
He stood behind the younger Kim in Wednesday's mass funeral parade, escorting the hearse carrying the coffin.
Solemn and grimacing, the younger Kim, believed to be born in early 1984, stood motionless throughout the ceremony. He only came to the forefront of the North's dynastic succession last year by taking on key military and ruling party posts.
"Comrade Kim Jong-un is the highest leader of the party and people who takes on Great Leader Kim Jong-il's philosophy and leadership, personality and morals, courage and audacity," Kim Yong-nam said.
CRUEL AND CUNNING ENOUGH TO SUCCEED?
Mourners, their heads bowed as the ceremony concluded, spilled over to both sides of the Taedong River as temperatures stood at about minus 10 Celsius (14 Fahrenheit). Boats moored on the river and trains in their yards blew their whistles for three minutes to mourn Kim Jong-il's passing.
The eulogies were short on boasts about economic achievements from a strongman who used his Songun, or "military first," policy to divert resources to build a conventional and weapons of mass destruction program.
The North's economic output is now smaller than in the 1990s under the rule of his father Kim Il-sung, who founded the state in 1948, and it has been squeezed harder under international sanctions for its missile and nuclear tests.
Gyorgy Toloraya, a Russian expert who is Director of Korean Programs at the Institute of Economy at the Russian Academy of Sciences, who met Kim Jong-il for the first time in 2000 described him as "fast and witty and having "a remarkable memory" on any subject.
"...one exclusion might be modern economics, in which he, it seemed, was not so very interested, regarding it just as a tool for rich Westerners to extract profits from their fellow compatriots and poor countries," Tolaraya wrote on 38North, a website published by the U.S.-Korea Institute at Johns Hopkins School of Advanced International Studies.
Most Korea-watchers do not expect the North to stage a repeat of the attacks it undertook in 2010 when it killed South Korean civilians with an artillery barrage and, according to most observers, sank a South Korean naval vessel. It denied sinking the vessel and says it was provoked into the barrage.
It may take Kim Jong-un some months to assume the full panoply of official titles held by his father.
"The real question is whether the new Kim has the cruelty and cunning, qualities that his father and grandfather Kim Il-sung possessed in plenty, to preserve in the long run the essential engine of the destitute dynasty he inherits," wrote Sung-Yoon Lee of Tufts University, a leading North Korea watcher.

National Guard Troops Return Early From Afghanistan
Nineteen members of the National Guard returned home early on Friday.
The troops, members of the 684th Medical Company, were told they would be deployed for a year when they left for Afghanistan on Sept. 11 this year, 10TV?s Jessa Goddard reported.
Instead, they returned early to a welcome ceremony in Westerville.
Five-year-old Addison Yochum said that she was happy to have her dad home ? her wish for the holidays.
Her father, Capt. Robert Yochum, said that it was a gift to return to his family.
?I couldn?t have asked for anything else,? Yochum said. ?This is the best present we could have had.?
Yochum was assigned in Afghanistan as a med-surge nurse, whose duties included working in the emergency room and intensive care unit treating patients.
?We found out on Thanksgiving Day that some of us were going to be going home, so it was kind of the result of the troop draw down that took place,? Yochum said.
The Yochum family said that they had put Christmas on hold until after the homecoming.
?We're going to celebrate our Christmas on Sunday,? Yochum said.
The returning troops were part of a larger unit made up of 80 National Guard members. The remaining troops will return home to Ohio in the new year, Goddard reported.

Griffin, Baylor win record-breaking Alamo Bowl
SAN ANTONIO (AP) ? A thrilling, back-and-forth, record-shattering Alamo Bowl had barely ended when Heisman Trophy winner Robert Griffin III already started hearing the chants.
"One more year! One more year!"
One more year? There's still the craziness of what happened Thursday night to get through first.
Griffin wasn't dazzling in possibly his last college game ? and didn't need to be ? yet No. 15 Baylor still pulled out an incredible Alamo Bowl victory in the highest-scoring regulation bowl game in history, beating Washington 67-56 in the wildest shootout of this bowl season or any other in memory.
If this was RG3's final showcase before jumping to the NFL, it was a gripping goodbye to watch. One of the nation's most electrifying players was upstaged by an even more exciting nail-biter that shattered the previous record for points in regulation set in the 2001 GMAC Bowl.
"We went out in style!" Griffin shouted to his teammates. He paraded the Alamo Bowl trophy around the field before taking it to the front row of the stands and his mother, who's already been looking at her son's NFL draft prospects.
Griffin said he was still catching his breath after this one.
"I want Baylor nation to enjoy this," Griffin said. "It's not about me. I've got about two weeks. I'll enjoy this the next day, and then the next day, and then I'll make it."
The previous bowl record for a regulation game was 102 total points set in the 2001 GMAC Bowl between Marshall and East Carolina. That game went to double overtime and ended with a combined 125 points ? which still stands as the overall bowl record.
Baylor, which won its first bowl game since 1992, and Washington (7-6) also set a bowl record for total offense in a game with 1,397 yards.
Griffin had an unremarkable night, throwing just one touchdown pass and running for another. But Terrance Ganaway starred ably in his place, rushing for 200 yards and five touchdowns. His last was a 43-yard run with 2:28 left to seal Baylor's first 10-win season since 1980.
Washington quarterback Keith Price outplayed his Heisman counterpart, going 23 for 27 with 438 yards and four touchdowns. He also ran for another three scores.
"I think we'll have a hard time this bowl season to see a quarterback play as well as he did," Washington coach Steve Sarkisian.
Griffin was 24 of 33 for 295 yards ? and his only touchdown throw came on the game's opening drive.
Blown out in four other games against ranked opponents this season, the Huskies finally made one interesting. Not that it started that way after Baylor ran up 245 yards of offense alone in the first quarter ? awful even by the standards of Washington's defense, which is among the nation's worst.
Then the most award-winning QB in the country suddenly stopped looking like even the best one in the Alamodome.
Price, a sophomore who threw a school-record 29 touchdowns in his first year as the starter, began cutting into a 21-7 deficit with a 12-yard scoring strike to James Johnson. Seven minutes later he tied the game when Devin Aguilar somersaulted over the goal line after catching a 1-yard lob.
The overwhelming crowd of Baylor fans ? decked in green-and-gold Heisman shirts and armed with signs such as "Superman wears RG3 socks" ? stood in stunned silenced. That gave way to disbelieving gasps on the next series, when the typically sure-handed Griffin fumbled after getting popped by Andrew Hudson.
After that, it was practically a free-for-all of big plays.
A 56-yard touchdown dash by Chris Polk. An 80-yard touchdown catch by Washington's Jermaine Kearse two plays into the second half. An 89-yard scoring rumble by Baylor's Terrance Ganaway. Kearse again, catching and darting for 60 yards before getting dragged down, setting up Price's fourth touchdown toss the next play.
Back and forth, back and forth. One after another. In all, five plays covered 50 or more yards, three of them for scores.
"That was crazy," Baylor coach Art Briles said.
For an Alamo Bowl short on drama and light on matchups in recent years, it was a thrilling scoring spree that overshadowed the mere novelty of featuring the Heisman winner. And that in itself was a rarity for a bowl of this stature: Not since Ty Detmer took BYU to the Holiday Bowl in 1990 had a Heisman winner played in a bowl before New Year's Day.
Plenty came to see this one.
Anticipating a surge of Heisman gawkers, Alamo Bowl officials added 800 temporary seats and opened up others with obstructed views that required ticket-buyers to sign a form acknowledging the poor sightlines. Those seats sold, anyway, and the announced attendance of 65,256 was the fifth-largest in the bowl's history.
Others had better seats.
That includes Miami Dolphins general manager Jeff Ireland, who kicked for Baylor in the late 1980s but was here on business scouting Griffin in case the fourth-year junior enters the draft. Griffin's parents, two sisters and fiancee watched the nail-biter with front-row seats.
Griffin acknowledged this week his parents are looking at his draft prospects but denies having any substantial talks with them.
Win or lose, it was an impressive finale for Washington after stumbling into the postseason losing four of its last six. Particularly against a ranked team after then-Top 25 opponents Nebraska, Stanford, Oregon and USC all crushed the Huskies by an average of 24 points.

Arab monitors face crowds, blasts in second Syria tour (Reuters)
BEIRUT, Dec 28, Reuters - ? Arab League monitors in Syria faced angry crowds, gunfire and explosions during their second visit to Homs, the heart of a nine-month revolt against President Bashar al-Assad, online videos appeared to show on Wednesday.
Activists uploaded footage on the Internet showing crowds surrounding a monitoring team's car on Wednesday shouting "those who kill their people are traitors." In another video, orange-vested monitors rushed behind a concrete building amid heavy shooting and blasts.
The pictures were impossible to verify and most foreign journalists are banned from working in Syria.
The Arab League observers are in Syria to determine if Assad is keeping his promise to push through a peace plan and end his crackdown on the revolt that has pushed the country towards civil war.
Homs has been mired in violence during the uprising. City neighborhoods have been pounded with army tank fire and mortar rounds in recent months. Armed clashes have increasingly overshadowed the peaceful protests that began in March.
The head of the Arab League mission earlier said he saw "nothing frightening" on his first trip to Homs on Tuesday. But France called the comment from Sudanese General Mustafa Dabi premature and urged Syria to give his team full access.
"When you were in Homs yesterday 15 people died. We're not benefitting from your presence," one activist, named as Khaled Abu Salah, shouted at the mission in a video of its second trip on Wednesday in the Homs neighborhood of Baba Amr.
The Arab League has said the mission needs about a week to determine whether Assad has stuck to his promise to withdraw tanks and troops, free prisoners and start a dialogue with the opposition.
General Dabi earlier called on activists to give his team more time.
"Remember, this was only the first day and it will need investigation. We have 20 people who will be there for a long time," Dabi told Reuters, speaking from Damascus.
Washington also urged patience. "It was just Day One," State Department spokesman Mark Toner said. "We need to let this mission get up and running. Let them do their job and then let them give their judgment."
Assad has warned against foreign intervention which he says could spark a regional crisis. Assad says Syria is fighting foreign-backed Islamist terrorists who have killed more than 2,000 of its security forces.
State television on Wednesday said Damascus had freed 755 people detained in the unrest "whose hands were not stained with Syrian blood." Thousands remain in detention.
U.S.-based Human Rights Watch accused Syrian authorities of transferring hundreds of detainees to military sites off-limits to Arab League monitors and urged the observers to insist on full access to all sites used for detention.
Unobstructed access and uncensored testimony are crucial to the Arab League's mission. The monitors hit a snag on Wednesday when locals in Baba Amr refused to speak with the observers in the presence of a Syrian army colonel.
The monitors later returned unescorted but had to scrap an effort to check an area where residents believed detainees were being hidden, because gunfire erupted nearby, activists told Reuters by telephone.
CLASHES RISE AHEAD OF MONITORS
As the monitors toured Homs, other hotspots saw fresh violence, said witnesses and activists.
A video sent by rebels in Deraa province showed gunmen with faces swathed in checkered kerchiefs, firing automatic rifles at a convoy of security force buses. The Syrian Observatory for Human Rights said four government soldiers died in the ambush.
Security forces fired live ammunition and tear gas at an anti-Assad rally in Hama, another major flashpoint of unrest north of Homs, said activists. At least one person died and seven were wounded, they added.
Al Jazeera television showed gunfire, curls of black smoke and men marching down a street chanting, "Where are the Arab monitors?" One man was bleeding from the neck.
The delegation plans to send teams to central Hama, southern Deraa and northern Idlib on Thursday.
Despite the hitches, many Homs residents were pleased with what they said was a more diligent second tour by monitors, and relieved to have a respite from days of heavy gun battles.
"This has been less killing and shooting than usual so I'm feeling more relaxed," joked activist Mohammed Saleh.
In other video clips of the monitoring mission, observers scribbled notes as residents named missing loved ones and showed the team the body of a lifeless young boy shot in the back. The Syrian Observatory for Human Rights says three people died from gunshots in Homs on Wednesday.
RUSSIA PRODS ASSAD TO OPEN UP
Russia, one of Assad's few remaining allies and Syria's primary weapons supplier, urged Damascus to let the observers move around the country freely.
"The mission should be able to visit any part of the country, any towns or villages, and come up with its own independent, objective opinion about what is happening and where," Foreign Minister Sergei Lavrov said.
Activists say about a third of the estimated 5,000 people killed in unrest in Syria since March died in Homs. Dozens have been killed in the past week alone and thousands arrested in the months before the 22-state Arab League was invited in.
The monitors represent the first international intervention on the ground in Syria since the revolt began. Protesters hope their final report will nudge the world into action against Assad.

Jones-Drew: Suits fuel NFL's concussion crackdown (AP)
JACKSONVILLE, Fla. ? Jacksonville Jaguars running back Maurice Jones-Drew wonders how much of the NFL's efforts to prevent or properly treat concussions have to do with lawsuits brought by former players against the league and its teams.
The NFL's leading rusher spoke out about the issue again Wednesday, nearly a week after telling The Associated Press he would hide a possible head injury so he could stay in a game.
"I've had concussions before, and it wasn't this big deal about concussions," Jones-Drew said. "The only reason they're making a big deal about concussions right now is because the league is getting sued over it. Before this, you never heard about it. A couple of years ago, you didn't hear anything about it."
After NFL Commissioner Roger Goodell was grilled about his sport's concussion policies at a congressional hearing in October 2009, the league made several significant changes. Those moves have continued, including this month's addition of certified athletic trainers sitting in booths during games to keep an eye out for possible head injuries and alert teams' medical staffs.
Starting this summer, at least eight lawsuits have been filed against the NFL by dozens of retired players who say they have medical problems related to brain injuries from their time in professional football. The NFL's stance, in part, is that players knew there were risks of injury, and there was no misconduct or liability on the league's part.
Jones-Drew called the possibility of serious injury in football an "occupational hazard."
He was one of 44 players the AP interviewed recently about concussions. Slightly more than half ? 23 ? said they would try to hide a concussion and stay in a game rather than pull themselves out.
Players generally indicated they are more aware now of the possible long-term effects of jarring hits to the helmet. Five said that while they would have tried to conceal a concussion during a game in 2009, now they would seek help.
Players also said they should be better protected from their own instincts: More than two-thirds of the group the AP talked to would like to have independent neurologists on sidelines during games.
"You know playing football you're going to get hurt, right?" Jones-Drew said Wednesday. "In the back of your mind, you've got to know that the worst that can happen is you can break your neck and be paralyzed for the rest of your life, right? Scholars want help identifying slaves' origins (AP)
WASHINGTON ? Almost two centuries before there was a man named Obama in the White House, there was a man named Obama shackled in the bowels of a slave ship. There is no proof that the unidentified Obama has ties to President Barack Obama. All they share is a name. But that is exactly the commonality that Emory University researchers hope to build upon as they delve into the origins of Africans who were taken up and sold.
They have built an online database around those names, and welcome input from people who may share a name that's in the database, or have such names as part of their family lore.
"The whole point of the project is to ask the African diaspora, people with any African background, to help us identify the names because the names are so ethno-linguistically specific, we can actually locate the region in Africa to which the individual belonged on the basis of the name," said David Eltis, an Emory University history professor who heads the database research team.
So far, two men named Obama sit among some 9,500 captured Africans whose names were written on line after line in the registries of obscure, 19th century slave trafficking courts. The courts processed the human chattel freed from ships that were intercepted and detoured to Havana, Cuba or Freetown, Sierra Leone. Most of the millions of Africans enslaved before 1807 were known only by numbers, said James Walvin, an expert on the trans-Atlantic slave trade. Once bought by slave owners, the Africans' names were lost. Africans captured by the Portuguese were baptized and given "Christian" names aboard the ships that were taking them into slavery.
But original African names ? surnames were uncommon for Africans in the 19th century ? are rich with information. Some reveal the day of the week an individual was born or whether that individual was the oldest, youngest or middle child or a twin. They can also reveal ethnic or linguistic groups.
The president's father was from Kenya, on the eastern coast of Africa, and Eltis said it was rare for captives to hail from areas far from the port where their ships set sail. The unidentified Obamas on the slave ships sailed from west Africa. Walvin, author of "The Zong," a book about the slave trade, said there were Africans who had been brought great distances before they were forced onto ships.
"Often their enslavement had begun much earlier, deep in the African interior, most of them captured through acts of violence, warfare or kidnap, or for criminal activity ..." Walvin said in his book, which chronicles the true story of a captain who ordered a third of the slaves aboard his ship thrown overboard due to a shortage of drinking water.
Obama's ancestors, a nomadic people known as the River Lake Nilotes, migrated from Bahr-el-Ghazal Province in Sudan toward Uganda and into Western Kenya, according to Sally Jacobs, author of "The Other Barack", a book about the president's father. They were part of several clans and subclans that eventually became the Luo people of Kenya, Jacobs writes.
The president's great-grandfather's name was Obama. Obama is derived from the word "bam", meaning crooked or indirect, she said in her book.
But it's also possible that Obama was a name used by other cultural groups in Africa and for whom the name had a different meaning.
The slaves found aboard intercepted ships provided their names, age and sometimes where they were from, through translators, to English and Spanish speaking court registrars who wrote their names as they sounded to them.
Body scars or identifying marks also were recorded. The details were logged in an attempt to prevent the Africans from being enslaved again, which didn't always work.
Emory's researchers are including audio clips of the names as they would likely be pronounced in Africa.
"These people enslaved were not just a nebulous group of people with no place and no name," said Kwesi DeGraft-Hanson, one of the researchers, who has found variations of his name, his brother's and his children's names in the database. He is originally from Ghana. "That's how lot of us view slavery. We don't have names faces to go with it ... It makes them that much more removed from us."
Eltis and his researchers acknowledge the database may not help African Americans with genealogical research because records on the Africans once they were freed from the ships are harder to find, if they exist at all.
However, the project provides another piece in a major jigsaw, and helps put together a bigger picture on slavery, Walvin said.
Before this project, Eltis and others assembled a database of 35,000 trans-Atlantic slave ship voyages responsible for the flow of more than 10 million Africans to the Americas.
Together, the two databases provide some details on the horrific voyages of the Africans, including the Obamas.
The Xerxes, which carried one of the unidentified Obamas, was a 138-foot schooner that began its voyage in Havana with a crew of 44. Five guns were mounted aboard when the ship left on a slave purchasing trip to Bonny on Feb. 10, 1828.
Sailing under the Spanish flag, the ship's captain Felipe Rebel purchased 429 slaves, nearly one third of them children, before setting out on a return trip to the Americas. But on June 26, 1828, the Xerxes was intercepted and forced to dock at an unknown Cuban port. By then, 26 slaves had died.
The other unidentified Obama, 6-foot-3-inches tall, was one of 562 Africans shackled in the belly of the Midas. The vessel was a Brig, a fast, maneuverable ship with two square-rigged masts. It was equipped with eight guns.
Midas' captain J. Martinez and a crew of 53 left Cuba on an unknown date. It left Bonny with 562 slaves but was intercepted. It docked in Cuba July 8, 1829 minus 162 slaves who had died during the voyage.
Some slaves freed from seized ships were returned to Africa, but not always to their original homelands. Some were sent to Liberia or were allowed to remain free in the cities where the courts were located. Some may have been re-enslaved and some died on ships that were returning them to Africa.

Energy Transfer Partners: Are Distributions Sustainable?
Readers of my prior articles on Buckeye Partners (BPL), Plains All American Pipeline, (PAA) and Enterprise Products Partners (EPD) may choose to skip the three following paragraphs since they contain general information relating to my approach with which they may already be familiar.
As an investor seeking the high yields being offered by MLPs, I look carefully at what portion of the distributions being received are really ?earned? and generally seek to avoid or reduce positions in MLPs that fund distributions with debt or through issuance of equity (i.e., sale of additional partnership units). Since money is fungible and the MLP financial statements are voluminous and not always easy to read, ascertaining whether you are genuinely receiving a yield on your money (rather than of your money) can be a complicated endeavor.
In addition, it is important for a conservative investor to understand how safe is the current return before tackling the question of what are the MLP?s growth prospects. Sustainable distributions provide some protection in that under a downside scenario those MLPs that cannot maintain their distribution rates are likely to suffer significantly greater price deterioration.
In prior articles regarding Buckeye Partners, L.P., Plains All American Pipeline and Enterprise Products Partners, L.P., I noted that ?sustainability? is not a clearly defined term and one has to settle on a subjective measure that one is comfortable with. My approach begins with the requirement that to be considered sustainable, an MLP?s net cash from operations should at least cover maintenance capital expenditures plus distributions over a 6-9 months measurement period.
Energy Transfer Partners (ETP) has not raised distributions to its limited partners since 2Q 2008 but offers a high (~7.80%) yield relative to some other large cap MLPs. How does the sustainable DCF generated by ETP compare with its level of distributions? My analysis is provided in the table below:

By my calculation, sustainable DCF for the 9 months ending 9/30/11 was $737 million. The principal difference vs. the $827 million reported DCF is attributable to $63.5 million of cash generated by risk management activities and $17.7 million of net income attributable to non-controlling interests. In my view, the latter item does not qualify in the distributable category, let alone as sustainable DCF, because the cash generated by that income is not cash that limited partners are entitled to. It will be distributed to others (RGP, to be precise, for its 30% interest in Lone Star, which is included in ETP?s consolidated financials).
The $63.5 million of cash generated by risk management activities presents a more complex issue. Generally I do not consider cash generated by risk management activities to be sustainable, although I recognize that one could reasonably argue that bona fide hedging of commodity price risks should be included. The problem I run into is that risk management activities encompass many kinds of items, including: (i) net changes in fair value of derivatives; (ii) amortization of net losses related to monetization of derivative instruments; (iii) currency hedges and valuations; (iv) unrealized gains on non-hedged interest rate derivatives; (v) unrealized gains and losses on commodity risk management activities; (vi) gains and losses on non-hedged interest rate derivatives; and (vii) proceeds from termination of interest rate derivatives. In the case of ETP, the $64 million appears to be principally related to floating-to-fixed swaps used to hedge interest rates associated with anticipated note issuances. I would not consider this a sustainable item. Since I have not yet developed a methodology for reliably differentiating between the various risk management items, I therefore exclude them from my analysis.
The impact on coverage ratios is shown in the table below:

Since distributions substantially exceed sustainable DCF, I have concerns regarding ETP. Short term, sustainable DCF may be further reduced due to the $2.9 billion sale of ETP?s propane operations to AmeriGas Partners, L.P. (APU) and if in 2012 ETP will consume, rather than generate cash from, working capital. The concerns are somewhat mitigated by prospective drop-downs resulting from the merger of ETE, ETP?s general partner, with Southern Union Gas.
I find it helpful to look at a simplified cash flow statement by netting certain items (e.g., acquisitions against dispositions) and by separating cash generation from cash consumption.

The period-to-period analysis for ETP shows a marked deterioration, although net cash from operations, less maintenance capital expenditures, less net income from non-controlling interests did cover distributions. But it did so only thanks to cash generated from working capital and the $86.2 million excess should be viewed with that in mind. The $237.8 million excess in the prior year period is also due to reductions in working capital. Working capital may not be a reliable source with which to fund distributions. As a reminder, in 2009, ETP?s working capital consumed, rather than generated, cash and the amount was significant ($320 million).

Wendy's goes gourmet in Japan

Today, fast-food chain Wendy's, known for its cheap staples of meat bombs, unveiled the Foie Gras Rossini Burger at its new restaurant in Tokyo.?The price is 1280 yen, or nearly $17 at today's exchange rates.
Other surprises in the new "Japan Premium" line-up of burgers include the Avocado Wasabi Burger, the Chili Burger, and the Truffle and Porcini Grilled Chicken Sandwich.
No other Wendy's in the world has foie gras, the liver of a specially fattened goose or duck. The burgers bulge and glisten with oil like sumo wrestlers.
The fancy burgers are sold at a gleaming new store in the Ometsando district of Japan's capital, famed for its fashion shops. The location is a bit away from the main drag though; find it on a map, here.
The store is Wendy's first of 100 planned locations for the country, according to the Wall Street Journal.
The fast-food empire bowed out of Japan a couple of years ago due to falling profits, reports AFP.
The new menu items can be seen on the Japanese website for Wendy's. There's no Baconator Double on it, sadly.

China speeds up QFII approvals amid signs of capital outflow (Reuters)
SHANGHAI (Reuters) ? China has since October granted nearly $1 billion in quotas for foreign institutions to invest in the country's capital markets following a five-month hiatus, reflecting Beijing's desire to encourage inbound investment amid signs of a capital outflow.
Combined quotas granted under the Qualified Foreign Institutional Investor (QFII) scheme in 2011 totaled $1.92 billion, the lowest since 2007, partly due to an approval freeze between May and October, according to official data released on Thursday.
Some analysts attributed the temporary suspension to the government's intention to ease pressure on the yuan to appreciate, but the tide changed abruptly in October as market jitters about the global economy prompted some investors to withdraw, weakening the yuan against the dollar in the onshore market.
"Typically when the yuan faces pressure to appreciate, regulators slow or suspend quota approvals," said Howhow Zhang, head of research at Shanghai-based consultancy Z-Ben Advisors. "I think now, because there is a capital outflow, approvals are being accelerated."
In December alone, five foreign institutions including Italian insurer Assicurazioni Generali SpA (GASI.MI) and Spanish bank BBVA SA (BBVA.MC) obtained combined QFII quotas of $500 million, according to the State Administration of Foreign Exchange (SAFE). That compares with $250 million granted in November and $200 million in October.
Zhang said the data reflected the regulator's desire to accelerate QFII approvals.
Newly-appointed China Securities Regulatory Commission (CSRC) Chairman Guo Shuqing said earlier this month that the watchdog would speed up approvals under the QFII scheme.
Under the system for allowing controlled inflows of capital for financial investment, the CSRC grants licenses to qualified institutions but foreign exchange regulator SAFE grants the quotas.
A sister scheme for allowing fund outflows, the Qualified Domestic Institutional Investor (QDII) program, has grown much more rapidly in recent years.
QDII quotas had risen to $74.95 billion as of December 21, up from $68.36 billion at the end of 2010. However, new quotas of about $820 million in the last three months of the year were much smaller than in the first three quarters.
In another sign that Beijing is encouraging inbound investment, China recently published rules allowing the Hong Kong subsidiaries of Chinese brokerages and fund houses to raise offshore yuan to invest domestically, under the Renminbi Qualified Foreign Institutional Investor, or RQFII, program.
The name refers to the fact that such investments are denominated in renminbi.
China launched the QFII scheme in 2003 to allow qualified foreign institutions to buy mainland stocks and bonds, and has so far granted total combined quotas of $21.6 billion.
